Retirement only

The exemption applies on retirement or resignation. Encashing leave while still in service is fully taxable, whoever the employer is.

A lifetime limit

The cap applies across your whole career, not per employer. An exemption claimed at an earlier job reduces what remains available now, which is why the earlier claim is an input here.

Thirty days a year

The leave-credit condition allows thirty days for each completed year of service, regardless of a more generous leave policy. Service is counted in completed years, so eleven months counts as nothing.

Frequently asked questions

Is leave encashment exempt for government employees?
Yes, fully, on retirement. The four-condition test applies to everyone else.
Does the exemption apply in the new regime?
Yes. Section 10(10AA) is a retirement exemption and is available under both regimes.
What if I retire from two jobs in a lifetime?
The cap is cumulative. The second claim is limited to whatever is left of the lifetime limit.
