Holding period decides everything

Listed equity turns long term after twelve months. Unlisted shares and immovable property take twenty-four. The same profit can be taxed at very different rates depending on which side of that line the sale falls.

The annual exemption

Long term gains on listed equity and equity mutual funds carry an annual exemption across all such assets together. It is not per transaction and not per fund — it is per person per year.

Short term on other assets

Short term gains on property, gold and debt funds are not taxed at a flat rate. They are added to total income and taxed at your slab, which for a higher-rate taxpayer is considerably worse than the long term rate.

Property acquired before July 2024

A resident individual or HUF selling property acquired before 23 July 2024 may compute tax either at the current rate without indexation or at 20% with indexation, and pay the lower. Compare both — the answer depends on how long the asset was held and how much prices moved.

Frequently asked questions

Is indexation still available?
For property acquired before 23 July 2024, resident individuals and HUFs may still opt for 20% with indexation if it produces a lower tax. Otherwise the current rate without indexation applies.
Can I set off a capital loss against salary?
No. Capital losses set off only against capital gains, with long term losses restricted to long term gains. Unused losses carry forward for eight years if the return is filed on time.
Does the exemption under section 54 apply to any property?
Section 54 applies to a residential house sold and reinvested in a residential house. Section 54F applies where any long term asset is sold and the proceeds are invested in a house. The conditions differ.
